Introduction and Parties
These Terms of Service ("Terms") constitute a legal agreement between LLC BrizoIT , a limited liability company organized under the laws of Ukraine ("LLC BrizoIT," "Company," "we," "us," or"our") and you, the user of our services ("User," "Customer," "you," or "your").
LLC BrizoIT is a software development company specializing in Atlassian Marketplace applications for Jira and Confluence, serving business customers globally through cloud-based and downloadable server/data center solutions.
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.Scope of Services
2.1 Service Categories
LLC BrizoIT provides the following services:
Cloud Applications:
Software-as-a-Service (SaaS) applications distributed through the Atlassian Marketplace that integrate with Atlassian Cloud products (Jira Cloud, Confluence Cloud).
Server/Data Center Applications:
Downloadable software applications for on-premises AtlassianServer and Data Center installations.
Support Services:
Technical support and maintenance services accessible through our support portal at

Professional Services:
Consulting, customization, and implementation services as may be separately agreed upon.
2.2 Atlassian Marketplace Integration
Our applications are distributed primarily through the Atlassian Marketplace. Your use of our applications is subject to both these Terms and Atlassian's applicable terms of service. LLC BrizoIT is responsible for the functionality and support of our applications, while Atlassian manages the marketplace platform, licensing, and billing infrastructure.
2.3 Service Availability
We strive to maintain high availability of our cloud services but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible. Service availability is subject to the underlying availability of Atlassian services and AWS infrastructure upon which our cloud applications depend.Account Registration and Management
3.1 Account Creation
To use our services, you must:
Have a valid Atlassian account
Provide accurate and complete registration information
Maintain the security and confidentiality of your account credentials
Be at least 18 years of age or have legal authority to enter into this agreement
3.2 Account Responsibilities
You are responsible for:
All activities that occur under your account
Maintaining accurate account information
Promptly notifying us of any unauthorized use
Complying with all applicable laws and regulations
3.3 Account Termination
We may suspend or terminate your account if you violate these Terms or engage in fraudulent,abusive, or illegal activities. Upon termination, your right to use our services ceases immediately.User Obligations and Acceptable Use
4.1 Acceptable Use
You agree to use our services only for legitimate business purposes and in accordance with these Terms. You will not:
Use our services for any illegal or unauthorized purpose
Violate any laws, regulations, or third-party rights
Interfere with or disrupt our services or servers
Attempt to gain unauthorized access to our systems
Reverse engineer, decompile, or disassemble our software (except as permitted by law)
Remove or modify any proprietary notices or labels
Use our services to transmit malware, spam, or other harmful content
4.2 Content and Data
You retain ownership of your data and content. You grant us a limited license to use, store, and process your data as necessary to provide our services. You are responsible for ensuring you have the right to use any data or content processed through our services.
4.3 Compliance
You agree to comply with all applicable data protection laws, including but not limited to GDPR, CCPA, and other privacy regulations that may apply to your use of our services.Intellectual Property and Licensing
5.1 LLC BrizoIT Intellectual Property
Our applications, including all software, documentation, trademarks, and related intellectual property,remain our exclusive property or that of our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use our applications solely for your internal business purposes.
5.2 Cloud Application Licensing
For cloud applications, your license is subscription-based and continues for as long as you maintain an active subscription through the Atlassian Marketplace.
5.3 Server/Data Center Application Licensing
For server and data center applications:
Licenses are perpetual but may require maintenance subscriptions for updates and support
Each license permits installation on a single server instance
Updates and new versions may require additional licensing fees
5.4 Open Source Components
Our applications may incorporate open source software components. Such components are governed by their respective licenses, which are made available in our application documentation.Data Privacy and Security
6.1 Privacy Policy
Our collection, use, and protection of personal data is governed by our Privacy Policy, available at

. The Privacy Policy is incorporated into these Terms by reference.
6.2 Data Controller/Processor Relationships
For certain applications, as disclosed in our Atlassian Marketplace privacy details, LLC BrizoIT does not act as a data controller or processor of customer data. In such cases, data processing is handled directly by Atlassian or remains under your control.
6.3 Data Security
LLC BrizoIT does not store or process End-User Data (including personal data) on its own infrastructure for its Atlassian Marketplace applications. All End-User Data remains within Atlassian's systems. LLC BrizoIT may store minimal operational metadata (such as configuration data or licensing information) solely for the purpose of providing and supporting the applications.
6.4 Data Retention
LLC BrizoIT does not retain End-User Data on its own systems. Any operational metadata collected(such as configuration settings or licensing information) is retained only as long as necessary to provide and support the applications, in accordance with applicable laws and contractual obligations.Support and Maintenance

7.2 Support Scope
Support includes assistance with:
Application functionality and configuration

7.3 Support Limitations
Support does not include:
Customization or development of new features
Integration with third-party systems not officially supported
Training or consulting services (unless separately purchased)
Issues arising from modifications to our applications
7.4 Maintenance
We regularly update our applications to fix bugs, improve performance, and add features. Cloud applications are updated automatically, while server/data center applications require manual updates.Fees and Payment
8.1 Pricing
Application pricing is determined by Atlassian Marketplace pricing models and is subject to change with reasonable notice. Current pricing is available on our Atlassian Marketplace listings.
8.2 Payment Processing
Payments are processed by Atlassian for applications purchased through the Marketplace.
8.3 Refunds
Refunds are handled in accordance with Atlassian Marketplace policies for marketplace purchases.
8.4 Taxes
You are responsible for all applicable taxes, duties, and fees related to your purchase and use of our services.Disclaimers and Limitation of Liability
9.1 Service Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LLC BRIZOIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.
9.3 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, or failures of third-party services (including Atlassian and AWS).Termination and Suspension
10.1 Termination by You
You may terminate your use of our services at any time by:
Uninstalling our applications from your Atlassian instance
Canceling your subscription through the Atlassian Marketplace
Contacting our support team
10.2 Termination by BrizoIT
We may terminate or suspend your access to our services immediately, without prior notice, if you:
Violate these Terms or our policies
Engage in fraudulent or illegal activities
Pose a security risk to our systems or other users
Fail to pay applicable fees
10.3 Effect of Termination
Upon termination:
Your right to use our services ceases immediately
We may delete your data in accordance with our retention policies
Outstanding payment obligations survive termination
Provisions regarding intellectual property, limitation of liability, and dispute resolution remain in effect.Governing Law and Jurisdiction
11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law principles.
11.2 Jurisdiction
Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ukraine.
11.3 Language
The original language of these Terms is English. Any translations are provided for convenience only,and the English version shall prevail in case of conflicts.Modification of Terms
12.1 Changes to Terms
We may modify these Terms from time to time to reflect changes in our services, legal requirements,or business practices. Material changes will be communicated through:

Updates to the Atlassian Marketplace listing
12.2 Acceptance of Changes
Your continued use of our services after the effective date of modified Terms constitutes acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of our services.
12.3 Notice Period
We will provide at least 30 days' notice for material changes to these Terms, except where changes are required by law or to address security vulnerabilities.General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms specific to particular services, constitute the entire agreement between you and LLC BrizoIT regarding our services.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent.We may assign our rights and obligations without restriction.
13.5 Independent Contractors
